The Copyright Laws have a provision of "Fair Use", which prescribes that one may use the copyrighted material in such a manner as not to cause any financial loss to the copyright holder and in a reasonable manner.
If you put a picture in your website and give the source of the picture then you are absolutely safe legally, no one can then sue you.
A notice is also required in civil suits before filing for any damages to mitigate the damage.

However usually the copyright holder will issue a "cease and desist" letter demanding that you remove the picture and promise not to use any of their copyrighted material in the future.
btw: the fact that you are not making money from the picture doesn't render it "fair use", and "If you put a picture in your website and give the source of the picture then you are absolutely safe legally, no one can then sue you." is absolutely false.

A lawsuit can only be succesfully pressed if the copyright holder has sustained damages. A picture on a website is unlikely to have caused economic harm to the copyright holder so legal recourse would be limited to ordering you to take it down.

They should send a cease and desist letter right off the bat. I have an understanding that they only have grounds to sue if you are making money off of the copyrighted image.

I am pretty sure you will not be sued if, together with the picture, you publish in good evidence the name of the author. Obviously, no misuse of the picture shall be done.

You can be sued for just about anything, so most likely yes.....
