My ex did not pay child support in 15 years now the kids are living with him and I have to pay child support, can I go after him for the last 15 years of child support even though none was ordered?

If there was not an original order for him to pay child support, then no. He will not be required to pay it back to you.

You need an attorney to figure this out for sure. child support should have been ordered at the time of the divorce so make sure that is wasn't and you just didn't find out about it. You may even have a lawsuit against someone for not ordering child support to be paid when you had the kids. You probably can't recover for the 15 years if none was ordered then but if he is making enough money you may have to pay little if any now, but you need an attorney to figure this all out. Go to legal aid if you can't afford one. Good Luck!

If you have no court order and there was no agreement for child support, you will have a nearly impossible time going after him for back due child support...especially since the kids now live with him. Most companies, as well as Dept. of Child Support require a court order to go after someone for back due child support.

If there was never any court order for him to pay child support then the answer is NO. I am sorry you are having to pay when all those year he did not.

Child support can only go retroactive to the date of filing. Since you did not have an order at that time, you cannot go back for support. This is the same for him as well.

No, there has to be an order for child support for the state to be able to enforce it. Back child support is only ordered from the date you file. If you no longer have primary custody you can't go back in time and file for the period when you did have them.

If you didn't have a court order they are not giving you back support. Support starts from the day you file for it. They are not going to out of the blue hand him a 15yr debt he was never ordered to pay.

You can't but your kids can when they are 18. I know a girl who sued her father for 10 years back child support that her mother didn't get so she could go to law school. She won..

You have to have a order of support from the court in order to get it...But you would think that he is still their dad and he should have been helping all along.Call one of those free advice lawyers to see where you can go to get the help you need.

Dont listen to Joox. Yes you can go for back support. That support is what was supposed to help go towards lights, water gas toys clothes food, you know things kids like to have.
