I am renting a house, and after I moved in, my landlord wants to charge me a prorated rent that they didn't disclose to me before I moved in because they assumed that I was moving my stuff in the house, but not physically moving in. Am I required to pay the prorated rent? They also have some of their stuff still in the house.

my landlords thoght I was only moving my stuff in. And when I said are u going to prorate my rent they answered no. Now after I move into the house they want to prorate for 1week. Oh, the lease still hasn't been brought to me. When I told them in October that I was going to move in early they assumed I was going to only my stuff because my apartment lease was till the 30th. I mved in to the house 1 week early.

I had a little old lady scream at me because she rented a place from the first of the month, but her moving van didn't get there until the 3rd. I told her I didn't care if she lived in the place AT ALL- she signed the lease stating she wanted POSSESSION on the 1st and that's what she paid for.

She still hates me. Such is life.

You, on the other hand, don't have a signed lease yet, and THEIR stuff is still in your house? Hmmmm. I'd say you don't have possession of the house yet. Tell them since you're not able to take possession of the ENTIRE house, you'll SPLIT the pro-rated rent.

Don't give them ANY money or sign anything until you have the date THEIR stuff will be out of the house IN WRITING.

are you saying you spent the night there before the day that you had agreed on. Usually you and landlord would agree when you can start moving your stuff in and when you will be actually sleeping there. When you start sleeping there is when your rent would start. Yes you would be required to pay for days that you were sleeping there. But your question is a little hard to understand is that what u were asking. As for their stuff if they try to leave that there they are trying to take advantage of you. But jsut haveing it there could mean that they didnt know what you had in mind.

I f you have signed a lease and took POSSESSION of the house then you do owe prorated rent....even if you haven;t actually moved in yet.
example: signed lease on Nov 15th for a move in of the same date. but you don't physically move your stuff in until Nov 20. That means you took possession of it on the 15th and owe rent from that date.

If you are living there before the time your rent starts, yes they can - they could even if you just moved your stuff in but didn't actually start living there. But there should be some adjustment for the space you can't use because their stuff is still there.

You need to pay for anytime you or your possessions have occupied the unit. Consider yourself lucky...most landlords would of charged you for full rent for just moving your "stuff" in. They don't need to disclose to you the obvious....you stay, you pay.
