Me and my fiance are having a rather interesting debate. It all began when we were reading about Hulk Hogan and his wife getting their divorce. I mentioned "what if" breast implants were assets, and "what if" the husband could sue for them back. Wouldnt that be funny? Well, my fiance says that legally they can do that. I of course know this, because there is no way that you can be forced to go under the knife to have the implants removed against your will. However, i argued that i can see it logical that the wife would have to pay back the money invested into the implants to the husband. My fiance is very adament about it being legal to have them removed. Let us know the truth! I mean, I already know, but drop a note so i can prove it to him! Thanks!

If the wife pays the husband back for the implants, then the "use" and "entertainment" and "joy" the husband derived from the implants, for the length of time they've been implanted, must be deducted from the amount the wife is to pay the husband.

Okay, what if the wife needed a pacemaker....the husband fronts the bill then they divorce....can he sue for the return of the pacemaker? What if it's a knee replacement...or a kidney transplant.......hey, he fronts the cost of a tatoo...does he get the tatoo back? What if it's the wife who fronts a penile implant to treat her hubby's ED...does she get the penis in the divorce? After all she paid for it......

No, no one can be forced to have any kind of invasive surgery for any reason...you have the right to say no because it is your body and since every surgical procedure carries a medical risk...even death in rare cases, no one can be legally forced to assume that risk....even if it's a surgical procedure that will save their life.....
...so at best, an ex may be able to get the cost of the breast implants, but not the implants themselves......
.....ask your Hubby to show proof of the legal theory...there isn't any.

No they cannot ask you to return a implant which is now part of your body. That would be like wanting a kidney back or something. Maybe for the price of the boobs but not the boobs. What would they do ? Give em to you in a jar lol

I seriously doubt that any court is going to force a woman to give back her implants...I don't know about having to pay 1/2 of it back to the husband...unless he can prove that he paid for it all in the first place..

I would say/think that if it were the husband who wanted the wife to have the implants--NO, he can't sue or want the money back.
If the wife wanted the implants then I would have to say/think the husband could ask for repayment ONLY IF he wasn't in agrement with it to begin with.

no don't think so but he can sue to get money for them unless you can prove that they were a gift than he has no rights to your implants.

I don't believe they could force you to go under the knife to have them removed. That would violate your constitutional right to refuse medical treatment for any reason. He could sue for the money he paid for them, however.
lol@Mignon. . .I wonder what man wouldn't agree to his wife having bigger boobs! That's hilarious and something I hadn't even thought of!!
