My under age daughter was checking out her new phone and found a video dated 2 months before she got the phone.As a parent I am very angry and offended. The phone was purchased as "new" from a major retailer. Our family is very religious vehemently opposed to all forms of porn and exploitation. What can I do about this?

I'd drop the religion for a minute or two and stick that phone right up the **** of the guy that sold it to you. Call a lawyer..you might get paid! Scratch that..I'd bet you will get paid.

You can either delete the porn and give her the phone, or you can go back to the store and tell them it was a used phone and you want either your money back, or the phone replaced with a new one.

Be aware that it's not unlikely though that 'somewhere' buried in the small print of the cell companies terms and conditions it says that a returned phone may be provided, in which case you have no grounds for any action.

If by "What can I do about this?" you're thinking lawsuit, nothing. You have no damages. Being offended isn't actionable, and there's no crime in giving her the phone with a porn video on it unless you can prove that the store clerk intended for the porn to be seen by a minor, which is unprovable.

First talk to your daughter about what she saw and watched. Honesty is your best bet, after all you cant keep her from something that she will find out eventually. Its horrible that it happened but she needs to know. Second take it back to the store and demand to speak with the owner, not manager because lets face it, owner is best. Then take it to the company and demand that you get a full refund, and etc....If it is a major retailer like Sprint, Verizon or Cingular the corporation needs to know wbout the outlets mistake asap!

As a parent, if she had'nt watched it, i would delete the video and not tell her about it.

If she had already watched it, one or multiple times, tell her about it. Be truthful as to what is happening in the movie. Thats the best you can do.

Take it back to the store and demand to talk to the store manager...it sounds like he's dealing in stolen goods.
