The Constitution only allows taxes on goods and/or a flat tax for everyone. The personal income tax amendment was never ratified. In addition, all the money our government collects from taxes on your income goes to pay of only the interest (not principal) on our 7 trillion dollar national debt. What do you think about that?

Article I Section 8 states "The Congress shall have Power To lay and collect Taxes..."

Section 9 states "No Capitation, or other direct, Tax shall be laid, unless in Proportion to the Census or enumeration herein before directed to be taken."

The only limitation on the power of Congress to tax is that DIRECT taxes must be apportioned among the states. Your statement that the Constitution only allows taxes on goods and/or a flat tax for everyone is incorrect. Many people believe that income taxes are direct taxes, however, income taxes are INDIRECT in a constitutional sense. Even if income taxes are considered direct taxes, the 16th amendment removed the apportionment requirement from being applied to income taxes.

The 16th amendment was properly ratified regardless of what anybody says. The courts have consistently upheld the passage of that amendment and its validity for the past 94 years.

Income taxes only go to pay interest on the national debt -

In order for all income taxes to go to just the interest on the debt, the interest rate would have to be close to 12%. The interest rate isn't anywhere near that. Currently, the interest rate on the U.S. debt is about 5%.

You probably read somewhere that all income tax revenue goes to the Federal Reserve which is another IDIOTIC conspiracy theory. The Federal Reserve does hold about $800 billion in U.S. Government debt. In 2006, the Federal Reserve collected about $36.5 billion in interest. However, as required by law, the Federal Reserve returned excess earnings to the U.S. Treasury. In 2006, the Federal Reserve returned $29.1 billion to the U.S. Treasury. This can clearly be seen on the INDEPENDENTLY AUDITED financial statements of the Federal Reserve.

The final arbitor on whether a law is constitutional is the courts. The Courts have consistantly upheld the constitutionality of income tax laws.

So unless you are a Federal judge making a ruling here, your opinion on the constitutionality of the income tax laws doesn't really count.

The 16th Amenedment has nothing to do with this issue. It merely finalized the legal categorization of the Income Tax. According to Stanton v. Baltic Mining Co., 240 U.S. 103 (1916), "The provisions of the 16th Amendement conferred no new power of taxation but simply prohibited the complete and plenary power of income taxation possessed by Congress from the beginning from being taken out of the category of indirect taxation to which it inherently belonged ..."

So ... According to the courts, the Income Tax is, in fact, an indirect tax. (Excise Tax) Well, that means that it is not the income that is being taxed but rather the activity associated with that income and further more, it is only the GAINS or PROFITS portion of said activity which are taxed. So, tell me ... how much of your paycheck is "Profit"?

"All of it", you say. WRONG! Is your labor worthless? Then you have in fact traded something for that money and therefore that labor must be deducted before profit can be ascertained. So, how much is your labor worth? Who knows, certainly not the government, LOL. I would argue that there is absolutely zero profit in any "paycheck" since that money supposedly represents the value of your labor. Hence, you have traded your labor for an equal value in money ... thus, no profit!

Back to the "Excise Tax" issue. An excise tax is levied upon activities that are choosen and not generally necessary such as smoking (tobacco), drinking (alcohol), driving (you could technically walk), etc. Is the activity associated with earning your paycheck necessary to you? I would imagine so. What would happen if you just decided to stop working. You'd have no money, no home, no food, etc.

The truth lies in the Internal Revenue Code itself. Most of us are not liable to pay a federal income tax. The tax is, as previously discussed, an excise tax which is levied upon non-essential activities which one could avoid if they so choose. The simple fact is that the tax is only levied on certain activities such as working as a public official, working for the government, etc. These are not so-called "Common professions" meaning that you do not have the inherent right to do this type of work for money. Try to deliver US Mail without working for the post office ... hope you got bail money.

There is no law on the books which requires one to pay tax on labor - which the income tax we pay is nothing more than slave tax. In fact, you probably know that it was taxation which prompted the beginning of the USA from the ex-patriots of Britain.

* The word 'Income' has been redefined. At the time that our tax law was passed, it meant 'profit,' the proceeds of a corporation after deducting expenses. Now that definition has come to include 'wages,' the proceeds of a single individual selling his labor. We know this to be true by reviewing the congressional record of conversations on the floor preceding the vote.
* The 16th Amendment was never truly ratified. It was forced fed to an unsuspecting public in an era when morse code was the main means of communications. This is the Amendment our modern day legal system says justifies the income tax. Even accepting the 16th as legal, many court cases have declared that this amendment bestows no new taxing power, which renders the current Income Tax unconstitutional!
* Our current lawmakers are vaguely aware that the 16th Amendment is unconstitutional. When pressed, they admit in closed circles that the Income Tax is voluntary, thus it is legal!

Thus our lawmakers have the best of both worlds. They themselves are not obligated to pay income taxes while the rest of the nation is herded into compliance!

The 16th Amendment gave Congress no new power to tax - absolutely TRUE.

Originally, the national government taxed the states according to population, It was [originally] up to the states to collect this tax in whatever method was found appropriate by the legislature of that state (no taxation without representation).

This changed at WWI "the war to end all wars". Congress has the right to levy taxes [period]. it authorised the executive aka IRS to collect these taxes that we voluntarily assess ourselves- meaning we claim all of our income ans all the exemprions and deductions we are entitled to and send in the money. It does not mean that paying taxes is a voluntary thing like giving blood.

It's a shame that I've been wasting my hard earned money all of these years and blaming it on the welfare services provided to those that don't deserve it.

Guess I'll join the freedom from taxes folk at the local goverment holding facility after I request my refund.

Oh yes. The old "the 16th Amendment was never ratified" ploy. It's been tried several times in court, and was not very successful. If you think you have a new angle that has not been tried before, I wish you luck.

That's why the 16th amendment passed. It allowed the establishment of the IRS and federal income taxes.

HR 25 the fairtax bill requires the repeal of the 16th amendment.
