Well if the sex is done between a lady of more then 16 years of age with her free will & consent it will not be covered under the offence of Rape as defined under section 375 of the Indian Penal Code. If the sex is done between the parties for no commercial purposes then it will not be covered under the provisions of the IMMORAL TRAFFIC (PREVENTION) ACT 1956. Other then that there is no legal bar to indulge in such pre-marital sex, but for social & medical reasons.

Sex Laws In India

2016-12-12 17:01:00 · answer #2 · answered by ? 4 · 0 0

it is legal but not hassle free
if u have booked a room in a hotel and having sex and police raids the hotels they will harass the consenting adults of commercial sex terms. media will flash yr pics. at the end of the day there will be no case . But whole episode will make a hole in your pocket, and make police rich.
Indian police take special pleasure to raid such places to make money on sly leaving the field free for serious criminals.
Sex among consenting adults though legal is a good source of income of police also. Th ecost of proving is high
You should discount this factors also while consenting

sex and legal. what has legality got to with sex. it is a personal matter and sex between two persons ( willingly ) is out of the purview of law. premarriage sex with consent is the option of the two persons. The Law has nothing to do with it.

India, that ancient land of culture and wisdom, attracted many from abroad to learn the finest lessons on morality and philosophy!
Its Indus Valley Civilization was older than many known cultures.
Sex was not a taboo! But healthy and sane sex was advocated and promoted.
The moral code was all powerful and no one could break it!
Modesty was not prescribed to the woman only! Man was also obliged to be modest!
Our forefathers fought the British to wrest freedom to live our own way of life!
But the western immperialists were not worried over the loss of their colonies, they got an upper hand through their ecnomic and cultural hegemony!.
Our elders looked upon man and woman as humanbeinhgs with definite anatomical differences. They were concerned with good life and they lived long!
The westerners want to go through many things quickly!
Let us not copy them but follow our own predecessors.

Consensual sex is permitted even if it is pre-marital, it again depends on how u look at it.....though it was looked upon with disgrace having pre-marital sex in Indian conservative society but now a days its not the same.....Its not a crime here untill n unless its forced upon someone.

I don't think that it's legal yet....but I see no problem in it if it does. We don't have the right to control other people's lives....and it should stay that way.
