I received bad aftersales service from a company and advised them that I would write to newspapers and consumer websites if they didn't refund my money? What are my rights as a consumer in terms of bad service? When does it become defamation?

It becomes defamation of character when they can prove that you outright lied about their services, or exercised a reckless disregard for the truth (such as saying something without checking the source). If they can prove you did those, they have a case, but as long as you stick to the truth you are okay. Got to love the First Amendment.

You may call the Better Business Bureau and make a formal complaint against the company and possibly bring suit against them in small claims court. If you can document the "wrongs" done you I don't think that they would go after you unless you are very rich and still it would be unlikely, in my opinion, because of the negative publicity that would come out.

Just make sure you state the exact truth,and do not attack the company with false claims.You have to prove the company did not give the support promised in the service agreement.

Defamation requires a false statement of fact.

Saying "I think I got bad customer service" isn't defamation.

If what you say is true, it is not libel. Just make sure that your facts are absolutely straight, and don't exaggerate.

Riccino.. made an important point. If you want to protect yourself from libel, preface your oppinions with ''In my opinion. . .'', and get the ''facts'' straight.
