My child support worker called me and asked me who the person was that signed the ex's child support summons papers. It was his new live-in gf. I asked her if she could do that and the worker said she was not suppose to so now he has not been served. I told her who she was and that she lives there. Is this going to make it where he will not have to show up for court and i will have to wait even longer for my child support order???

Hmm someone aint reading correctly I DID NOT ASK ANYONE TO SIGN FOR HIM the sheriff allowed her to sign the papers NOT ME. but now i know that he did get them and he told me and the worker he got them so i hope that helps.

I would think the person who had served those papers would of served it to him not her. Yes it will probably tie it up some more because he will say he didn't know about the court date. Even though he may get served later on (and make sure he is the one who is served) he will still have to pay all that back child support from the day he left you.

If your case worker doesn't know the answer to this question, I would call the Sheriff's department, and ask them whether the summons is enforceable, with another person's signature. If the answer is no, have them serve the summons again, and get the correct signature. It was their responsibility to get it to the right person in the first place. Good luck!

Not sure if it causes a delay, but after they attempt so many times, the server can actually leave it posted so I don't know why someone couldn't sign for it, but then again, maybe each state has it's own rules.

YES! You had NO right to ask a girlfriend to sign ANYTHING on his behalf. How would you like it if someone signed your name to something? A check... Charge card... Court papers...
It is illegal to sign someones name for them. Unless you are the legal guardian. Even as a wife... or husband... it is illegal, unless it is a do or die situation.

who served the papers and why did she sign them? I think someone knowingly did it to postpone things.You should try to have them served by someone of authority with a police escort.

Probably. Simply look up the Judges chamber number..and call his secretary. She will be able to tell you what to do.
