My child support worker called me and asked me who the person was that signed the ex's child support summons papers. It was his new live-in gf. I asked her if she could do that and the worker said she was not suppose to so now he has not been served. I told her who she was and that she lives there. Is this going to make it where he will not have to show up for court and i will have to wait even longer for my child support order???

thanks for all the answers my case worker did call me and let me know that since she lives there yes he was served and has to show for court. But get this the dummy told me that he did not want to turn in his most recent check stubs cause he is making more money now but will make less after the holidays. so of course i call my worker back and tell her this she is now going straight to his employer for his earnings. live can be rewarding.

As Richard stated, the statutes of some states consider the service effective if the summons is left with a co-resident who is of mature age.

I imagine that the person serving the summons knows the rules in your state, and served the summons properly. If the summons must be accpeted by your ex, I'm sure the process server would have known this, and would not have given it to the gf.

Rules of service vary by State. In some States the person must be personally served, in some an adult co-resident can accept service.

I think that if someone in his household signed those papers he was officially served. The only thing I think now is if the papers said he had to sign for them specifically.

With my daughter, her DNA donor's sister's house always gets served and he has to do whatever. He doesn't do it but hey what can I say.

I wish you all the luck in getting your child support pumpkin! My daughters DNA donor owes us over 16k now and she's 7.... Also, check your laws with that, I think they vary by state..

One thing I have learned the the 17 years of child support is, do not rely on it.
If it comes treat it as extra money that fell from the sky, but do not rely on it.

I do not know about this situation, I sure hope it works out for you though!! The entertainment for you begins :0(
