Can anyone give me links or precise information regarding the following (in the U.S.) :

1. Can a cop ask you for your I.D. for no reason at all (he wants to see where you live for example)?

2. Can a cop search your back pack, purse or coat without giving you a reason?

3. Must an American citizen carry I.D. on them at all times (even if they're not driving)?

I'm not really interested if you're caught at an underage party, or at a place where drugs are being sold, I'm talking about the average citizen out walking about at 10 a.m. (going to the local coffee house for coffee) and a cop asks to see their I.D. for no reason at all.

No police officer may ask to see an ID card or search your person or personal bag, such as a backpack without a reason. You are not required to identify yourself or to carry ID to simply walk down the street. "Suspicion" is not a reason. There must be a suspicion of some criminal act.

He can ask, but if he has no reason (probable cause), he can't do any of the above without consent. There is a law about carrying ID, everybody should, but Police aren't going to worry about that, they have too many other things to worry about.

Whoever gave me the thumbs down, here is your proof. Don't try to tell me my business.

1. Yes you can be asked for ID at anytime....maybe you fit a description for someone they are looking for
2. They can search if they have probable cause. Probable cause could be acting suspicious
3. A citizen should carry ID at all times

They can ask all they want. You don't have to provide anything. No name, nothing. Of course, the bigger a pain you are to them, the longer they can legally make you stand by while they "check your file" etc.

Now, if they have "reasonable" reasons to search your vehicle, they can. Like if they "smell pot."

yes - they can ask - Supreme Court said so.
Without probable cause or your permission, they cannot search you or your property.

illegal search and seizure must have "probable cause" such as eratic behavior etc...
