If an office has potlucks during working hours, company christmas party etc. and everyone in the office is invited except one employee, is that consider discrimination?

It depends on whether or not the "one employee" falls into a protected class as determined by discrimination laws. If she is, for example, the ONLY female and all the rest are males, it may be a basis for discrimination. Likewise if s/he is excluded due to race, ethnicity, age, disability, etc. (the PROTECTED classes), then there may be a basis. If s/he is excluded simply because people don't like him/her or some other petty office reason, then there is NO discrimination, although it may begin to approach a hostile working environment.

You could take this to court but it will just be more hassle and heartache for you. I am sure this can't be the only sign you have seen of discrimination there. Look for another job now. Leave such people to their own devices because someone more powerful and wealthy than you will take action against them - I have heard of it happening.
