Suppose a wife is married 2nd time and has seperated and is considering divorcing the new husband, is she entitled to maintenance? She had collected lumpsum after first divorce through court. 2 nd marriage has broken due to husband's cruelty.

Yes, she is entitled every time she divorces unless she has been working steadily through the marriage. She may even still be entitled to any community property, unless there was a prenuptial agreement. All of this is depending on where you live, of course. If there are children, she will always get child support.

i agree men shouldn't get married because when they divorce, a woman (it may be the woman's fault why the divorce is happening) they get shafted. the courts take the house, car, & our money. us men we need to go to a state where there is no common law marriage like the great state of virginia ( no common law marriage)!!!! u can have the girl live w/ u w/out having to get married & if the girl cheats on u & does u wrong & wants to leave, u don't have to give her a dime. just don't put her on the mortgage lease & ur good

The first husband did not make payment for anyone but himself; how could he have done so? When this woman remarried she did not bring herself and her first husband's money into the union, she brought herself and what was then her own money and if she would have been entitled to maintenance had this been her first marriage then she is entitled to it still.

men should not get married. i think we should just have a live in relation and care the dam what anyone has to say about it. after all if the women splits men has to pay for it. so have a live in and if the women wanna go let them leave, there are plenty of them out there waiting for you..
