my sons dad filed for custody of our son. he is trying to prove me an unfit mother which isnt possible. i hired an attorney and have been fighting him every step of the way. we go to court dec. 4th. my attorney has done all his homework in order to prepare for this court date. my attorney filed a discovery paper to find out who would be testifying against me and see what kind of things they would be trying to use against me. my sons dads attorney hasnt done anything. no discovery paper, and no supenas have been filed and we have less than a week untill court. can anyone tell me why this attorney hasnt done any of the common things they are supposed to do in order to prepare for court? and what do you think is going to happen tuesday when i get there due to this attorney taking no action?

i am in ohio
my attorney DID file discovery and DID get a response
my sons dad's attorney has NOT filed a discovery paper and has NOT sent out any supenas
his dad filed for full custody

Be thankful that you have representation who is working for his money. Your baby-daddy's failed attempt at gaining custody from you will work to your benefit in the future so keep all the documents that you get. Once you have beaten him in court over custody, try and limit his interactions with the child. Dont get all wishy-washy about it, its the best thing to do. Next step, milk him for all of the support possible. Make him think twice before doing something like this again.

I think your soon to be ex is playing mind games. His attorney has not submitted any answers to discovery because there are none. My ex and his attorney tried the same thing and it didn't work. It's a scare tactic. I wouldn't worry. If his attorney doesn't submit any answers your home free and with trial date so close it's unlikely he'll answer at all!

Your ex is probably just trying to mess with your emotions by accusing you of being an unfit mother(what mother would not take that personally?). They are also probably trying to make you spend money on your attorney.

Not much if his lousy attorney has not been working on it. He will probably ask for an extension.

what are his grounds to prove you unfit? how old is child? discovery has to be answered... if not the judge can dismiss. what state are you in?
