now we were told that he would be out before closing and know that the former owner told him around nov 1st or 2nd that he needed to vacate cause the house because the house was beign sold to us. the termite guy and the apprasial guy commented on how rude he was saying he cant believe the house was sold out form underneath him. the first appraisal wasnt accepted so we hired a friend to do the appraisal and the tennant first told him that it had already been done and that he wasnt getting in but finally let him in and started ranting about the house beign sold. now from the termite guy to now hes been told and known that the house wad sold we put eviction notice on the doors and got a letter from his lawyer saying he wasnt properly notified. does a verbal eviction have any legal standings and other than a 30 day from me any other options in arkansas

Unfortunately, you've inherited a problem.

Proper notification is a gray area. The one eviction case I witnessed in court where it was brought up went against the tenant. The tenant said they weren't notified properly, but the judge asked them specifically if they had indeed received the notification, and they admited they had. So the judge pretty much said that was moot as they were in fact notified.

Look under the yellow pages under evictions. There are legal firms that specialize in this. Get them on the job stat!

What does your agreement with the previous owner state. If they were responsible for having the tenant out of there, you have been damaged and can sue them in small claims. Wait until all your damages are over with and can be added up, including legal fees to evict the tenant, and then sue the previous owner.

Have you seen a copy of the lease?

I tend to agree with LFG, but in addition you could be stuck with these renters until their lease runs out. It sort of depends on what the lease says about causes for eviction and also your state Landlord-Tenant Act, which, not living in Arkansas, I wouldn't have a clue about.

I do know that in many states it is very hard to evict a tenant in the middle of their lease even if they do something very bad, like stop paying rent or destroy your property! I mean, you can get them out, but it costs you money and takes some time.

Verbal means nothing. You must get it in writing. Did he pay rent to the old owner or has he paid rent yet? You can evict him with a 3 day notice if payment has not be received.
