No. It is not void. A verbal agreement can change the terms of even the requirement that the agreement be in writing.

The difficult part may be proving all of the elements within the oral contract. As long as those elements can be proven, together with the offer and acceptance, there is going to be a good contract.

If a contract is required to be in writing and it is not, the oral agreement may not be enforceable. But there are exceptions to this general rule.

It is still perfectly legal to go through with it, it is just that the courts won't help you resolve disputes.
