File for legal separation and have it court ordered, but if he isn't working, good luck collecting.

Only way to get support is through the courts ,legal aide you may be qualified for to help you obtain a divorce.Check your phone book for one.Also you can get state help and get food stamps and some money,which he will have to pay back.You need all the help you can get and if possible perhaps a job.As you are on your own and getting state help isn't enough to get you ahead in life.Some places have a discount on your salary you make for child care.You really should give this a lot of thought as a job is your best course

Not sure what state you live in, but yes he is obligated to pay child support... I would suggest that you contact the your states family court and find out how to go about filing for a Child support order... Even if you are only separated you can still get child support... The family court will make him get a job or lock him up (in some states)... Some states even suspend their drivers license... No, him being locked up wont help, but it should encourage him to get up off his lazy *** and get a job and realize that he has obligations... the child support obligation will not stop just because he does not have a job or is locked up... it will accumulate... How is he going to take care of a new baby if he cant take care of the 2 that he has with you...

You will have to go to court and request child support. If you are on public assistance (food stamps, etc) usually the DA will go after him for child support on your behalf. Until there is a court order, though, he is not legally obligated, even if he is morally obligated. Furthermore, when awarding back child support, the court cannot go back any further than the date you filed for support. So the longer you wait, the more money you lose.

I used to be legal secretary. There is legal aid thru the food stamp and such office. I promise you, esp. if you are in Texas, once he is ordered to pay child support, the Judge WILL make him continue to pay or go to jail for 90 days. This is the law in most states. The law doesn't care if your ex is working or not, he must support your children. Fight for your kids before it is too late------because the longer you wait the less likely the courts will help you. They will want to know why it took you so long to file and such and so on..........they deal strickly by the law ---------not the stupidity of a drunk. Good luck and God Bless you and your kids.

You need to get a lawyer from Legal Aide to help you out. The only way to get child support out of him if it is court ordered. However, if he is not working, then the court system probably can't force him to pay anything.
I'm just curious though...if his girlfriend has free housing, I would bet my last dollar that he is living with her illegally and the authorities don't know about him.

Get a JOB. Housing you said ?FREE? it's not FREE i am just like all the productive working, wanting to have something, Not looking for a hand out or FREEBIES hard working woman. You need to get a clue a support you own kids file the necessary paperwork with the court and he will have to pay or go to jail. So if he can lay up and make babies with another woman he should pay for the two he has with you. I know it's just not me plenty people that works hard for their money are sick and tired seeing abled body young adult having babies and expect someone else to pay for your responsibilities. GET A JOB!!!!!!!!!!!

You need to be asking your attorney this question, but here is the problem. You are not looking at the big picture.
If he is indeed an alcoholic, it will not be long before he is out of a job then you will be out of child support. So no matter what you do, do not count on him for any kind of finacial support.
The big problem is you need to start working on yourself, for the sake of your children.
You need to find an Al-anon meeting. Once there you need to find a sponsor and follow her suggestions.
As you already realize you cannot heal him. But what you may not realize is it is you that needs healing as well.

I dont know how much but you can file for separation at least. the I think you can go to the child support enforcement agency and ask what your next step should be to get support. I know in Washington state the minimum is $25 per child.

You need to get to court and file papers for child support. You don't need an attorney to do this. Call your division of child support in your area, they will send you a big packet and you fill it out. They will then contact him. You need to make it legal and get it mandated by the courts.
