Whats the procedure of getting a restraining order? Can anyone get a restraining order against her husband?

I am asking for my girlfriend, she is married but soon gonna file a divorce against the husband. They both never had a sexual relation(dont ask why) but we both are concerned what he might do. So can we get a restraining order just a precaution? coz the husband seems pretty crazy to me and i am worried about her security. Can we state this reason to get the restraining order? Thanks

Pretty much yes. I believe it depends on your city/state, but in my city, you go down to the courthouse, file for one and it is granted as a temporary one. Two weeks later, you both show up in court, state your case and the judge can either approve or deny the restraining order. If he doesn't show, it's automatically granted, but it's not effective until he is served. It's as simple as that. By the way, in my city, even though he's your husband and assuming you live together, once you get one and he is served, he can no longer live in the house you guys share.

it depends on what happened. 1st you have 2 file a police report. 2nd you have 2 take the report 2 criminal court. if you have children you have 2 go 2 family court and prove that the restraining order should be enforced 4 the child as well. Good Luck

Yes but first you have to show justifiable reasons to the Judge why he should oder your request. These arent issued for the hell of it and can be issued for any length of time. Also be sure you really want it as once issued you have to go back to court to get it squashed or terminated. Also Judges hate isuing one then terminating it and reissuing it for the same reason in a short amount of time. Also be prepared to file charges if your husbad violates it

If she has filed the order she should not be in difficulty if she chooses to interrupt it--yet she's making a extensive mistake if she does. The restraining order grow to be positioned into effect to guard her from this guy. The courtroom gadget won't take her heavily if she intentionally places herself in place to be close to him.
