My Drivers license was taken in Ohio and suspended. Now, I am left without an ID. If I get a state ID in Ohio, it cancels your drivers license all together and I would have to retake everything at a later point. It's illegal to have a ID and drivers license. Now, since my only ID is gone and I have no passport, I am less of a citizen. I couldn't get into an R rated movie at the age of 22. I couldn't buy a pack of cigarettes at the age of 22. I couldn't even cash my own check! I find it ridiculous they take you license and leave you with no ID. I was supposed to travel and am not even sure if I can get on a plane! Sure my driving privileges are suspended, but my life has been put on hold. I can't even do simple things like the movies anymore. I can't afford to get a passport rushed and even then, it takes more than a month. What am I supposed to do? Is there any room for a class action lawsuit? This needs to be resolved because I can't be the only person in this situation.

That is odd - even if your driver's license is suspended, that usually doesn't mean that they take away the ID card.

Do what #2 says - request an administrative hearing before the DMV.

Do you have a student identification card (from a college / university)? You can use that for identification purposes now.

Or, ask the DMV to return your driver's license card (for identification purposes only)...

You mentioned bringing a Class action because you had your license taken away and thus have no ID. You could bring a class action suit on behalf of all people simialry situtated under Rule 23 of the Rules of civil Procedure. There are requirements for bringing a class action, and they are : Commonality, typicality, Numerosity. The same common claim must be common to all those in the Calss action; the Class must be so numerous that to bring one case at a time per citizen would overwhelm the judicial system, and all the claims must be typical for each class member. Then you need a Class Representative who will bring the case in Court under the Class Action Rule 23 of the civil rules of civil Procedure and finally you must have standing to sue. If you statisfy all of those requirements a class action suit may be brought but remember some class members can Opt out if they choose. At any rate, it is feasible to bring a class action against the State of Ohio for this issue but ask yourself whether or not you are willling to do this. The better course is to bring one yourself alleging among other things you are being deprived of due process since you cannot function normally without your ID. Maybe a simple call to OHIO BMV will do the trick. Request an Administrative Trial type Hearing before the Ohio BMV. That could work also . Good luck and let me know how it turns out.

You are supposed to get an ID card. You wouldn't win a lawsuit as having a driver's license is a privilege, not a right.
