okay maybe i should have been more descriptive. first off the landlord just got fined for hiring unlicensed contractors to do work for these apts, second i was informed he doesnt have a license or whatvere to even RENT these apt. and i pay by money orders because they dont allow checks another thing prob illegal. i always give my rent to the apt manager because she lives here also and she backs me up saying yes i did collect ur payment for that month and all they have to do is check their bank record and just count how many deposits ive made since i lived there easy right? and i do understand the importance of keeping record as i said ironically i cant find that particular one. seriously if u dont really know real estate law i dont require ur answers thank you

OK, I didn;t see your first post, but my guess is that you say you paid your rent, and your landlord says that you didn't?

If he sues you you will have to show whatever evidence you can find that you paid. If you can't find the stub from when you bought the MO, what about bank records that show you withdrew the right amount from your bank on the day that you claim to have paid your rent?

Other chance, try going back to the store where you bought it. They'll have a list of all the MO's they sold. If you bought it at about 8 oclock on a Friday, say, and there's an MO for the amount of your rent times at 8:11, get that number and see what happened to it - if it was deposited into your landlords bank account...... bingo.

If you can't get any of that, you can subpoena the manager to testify that you gave it to her.

One word of warning though. I'm not sure what you mean by he doesn't have a license to rent the apartments. If you mean a business license, that's just an issue between him and the city, it doesn't affect your case at all. If you mean he doesn't have a certificate of occupancy for them, then the city could order him to evict you all *immediately* if you tell them about it.

Hiring unlicensed contractors is also only an issue between him and them, or between him and the city if they did work that local law requires a license for. (Such as gas work in many places.) Again, though, be careful - if you report to the city that unlicensed contractors worked on the gas lines illegally, they may red-tag the whole building right away and order you all evicted.

If you don't get receipts upon payment of cash, especially for your rent, you're not doing yourself any favors. Start demanding receipts.
