Unless there's discrimination (race, religion, etc.) involved, you cannot do anything about it. A landlord has the right to rent to anybody he wants and refuse anybody he wants.

Do you have your landlords promise in writing? If not, there is nothing you can do. (even if you had it in writing, the court battle would not be worth the bitter relationship that would brew between you two over this) Your landlord reserves the right to rent to whomever he wants. Sorry your landlord made a bad deal by promising you a unit you were not going to get. If your landlord likes to make empty promises, maybe you should consider moving. It really bugs when a landlord gives special preference to a family member. It may seem unfair, but he can do it.

The only preference you have is for the unit you currently occupy, and only as long as the LL wishes to continue renting to you. A LL is free to rent to anyone. And unless your agreement was in writing there's probably nothing that you can prove in court. If your LL promised something and did not deliver your option is to vote with your feet.

No, you have no legal preference. The landlord can rent to whomever he chooses, unless you somehow have this promise in writing.
