There was little damage that is visible to my truck, his car was totaled, (they had to cut the hood off to stop the leaking and remove the battery.) I am suffering back pain and numbness on the right side of my body. I have been previously diagnosed with DJD in the spine. Do I deal with the ins co or an atty?

Start with the insurance company and go to a lawyer if necessary.

Go through your insurance company.

In most areas they'll handle everything and will take care of getting a lawyer if its required. Let them fight for you if a fight is needed-they have more money than you and have much better lawyers.

The other guy isnt going to be able to get out of this anyway, so the only reason to get a lawyer is to try to screw him over. He made a mistake, he'll pay for it without you trying to ruin his life by suing.

Absolutely! Get everything you can. Set an example for all the other people who think they can drive illegally.
