VERY long story. My friend's husband asked for a divorce in July. She was shocked but wanting to keep it as clean as possible she let her son go stay with him in Germany where they were stationed at the time while she tried to get things together back "home" here in TX. The agreement was that in DEC her son be brought back to the states to reside with her. Now her husband is threatening not to bring her child back. We have no Idea what to do next. She wasn't actually SERVED with divorce papers but has seen a rough draft of his intentions.
The story is even more complex than I can write- but to sum it up, her husband left her here without a car, job, home or dime. And every lawyer wants 3000 up front to take her case.

Oh and HE committed Adultry and thats why he is divorcing her after 7 years.

She should call every lawyer in the phone book to ask if they will take the case, and her pay them out.Or have the lawyer set it up in the divorce papers that he has to pay all lawyer and court cost. She will need a very good lawyer, that knows about custody battles overseas.Since her son is in Germany she may have a hard time getting him back home. Unless his dad does the right thing. Im thinking she should call a lawyer and ask "should I call the US embassy in Germany to see if they can help get my son home?" Although I could be wrong. BEST OF LUCK TO HER!

What is your question? Sounds like he has a great shot at getting custody.

No kidnapping has occurred. He is the father and has the right to have his child with him unless there is a court order that says otherwise.

The military will not get involved in a civil matter. They can not by law.

His alleged affair may or may not be an issue in court. It will depend on the proof that exist *that the affair existed before the separation* and on the state law about "fault". Who left who is normally immaterial to divorce and custody issues.

She needs a lawyer. $3,000 is a reasonable retainer for a custody case.

She needs a very good attorney, and she needs to consult with the military. They generally don't allow their members to kidnap children.
