Ken's answer related to attorneys appointed by the court for an indigent defendant. If you hire your own attorney he can charge you whatever the two of you agree to.

In some high profile cases (Ken Lay / Jeff Skilling leaps to mind) attorneys fees can run into the hundreds of thousands.

They are paid an hourly rate. That rate is set by a panel in each area and is based on what is charged in that area. The $40,000 figure would be for a trial that required significant prep work. Most cases result in plea agreements. I know in my district there are very few $40,000 payouts to panel attorneys.
