He would not have to pay any additional child support from the time of his loss of all paternal rights but if the state spent money on your child support, then he will have to repay that amount to the state. It is called an arrearage and continues to collect interest until paid. He may even have ongoing child support depending on how the court worded the loss of rights. Generally, the financial obligation to support your children continues, even if you lose custody. However, if you release him from support obligations in exchange for his relinquishing paternal rights, then the court may accept that and waive any further obligation.

He's also still liable for child support in the future, UNLESS a *court* has terminated his parental rights. Signing away your parental rights and responsibilities is NOT something you can do unilaterally.

The government does NOT allow fathers to get out of their responsibility to their children just by signing away any rights they may have. You can relinquish your rights... you can NOT relinquish your responsibilities.

If your sons father signs away his rights, he does not have to pay child support. Then you can legally change their last name just like he never existed. Also, if you remarry, your husband can adopt them and change their name to his. What a creep if he will disown his kids legally just not to have to pay child support.
