It will vary depending on what state you live in. Some require a separation period of 6 months or so, others do not. Do a search for "divorce law" (and state name) and you'll get a bunch of sites that will direct you to your state laws and many have FAQ sections that address basic issues like that.
Depending on your circumstance, if the marriage was not consummated, you may be able to get an annulment. Check your state's requirements, and good luck.

Yes you can both seek divorce by mutual consent as your marriage is more than one year old and no husband wife relationship exist between you. The process will require filling and appearing for first motion and get six month date when second motion takes place and you are granted divorce on the same time if you both have not with drawn your consent. The proof of marriage you need one or two photographs of the Hindu Marriage ceremony and wedding card if you got that. Photo Identity proof of both parties and proof of residence of anyone of the party of the district where the Petition for divorce is being filled if this marriage was not solemnized in that district. Passport size photographs may also be required to be attached with the joint petition that you both file. You need to engage a lawyer for the complete job who shall fix services of another lawyer with him for this whole job as one lawyer will be representing one of the party.

Sometimes you make a mistake a realize right away it was a bad choice.
However, be advised that marriage isn't easy. Bailing out after just 3 months doesn't seem to have really given it a chance to work.

You can divorce after a day if you wanted to, look at Britney Spears. Just remember that you have to be living separate and apart for at least 60 days before the divorce can be finalized.

Yes, but are you sure that's what you want? They say that the first year is the hardest and if you can make it through that then you'll be okay. I would suggest to give it all you have, 100%! At least try, don't give up so soon. My first year was very hard and I wanted to leave a few times. But I am so glad I didn't!

Yes, but how can you you be sure that you are making the right decision and have put every effort into making the marriage work? I do not know the circumstances of your question, but three months hardly seems like enough time to put the effort forth to save the marriage.

You can but I think it is considered an annulment. You need to look into that because if you were married in a church and you get the marriage annulled... you can get married in a church again if you wish to... f you get divorced... you can never get married in a church again...

What you got the ring but it wasn't the size you wanted your pathetic. What no one ever told you that marriage is hard work and take alot of compromise and devotion and well commitment. Unless the person is abusing you or has cheated on you then they deserve for you to work on it and to stay strong.
