my landlord wants to make my aparment bigger and i been living here with my wife and my 3 kids. i already saw the form that she gave to the dept. of planning. my question what are my options in this situation. if the city gives her the approval. can she kick me out or does she has to give me a replacement i dont know can anyone help.

It all depends if you signed a lease or not and what that lease said. Every country has different laws that the landlords have to follow. Usually they have to give you a certain amount of time and yes they can make you leave due to renovations and or major repairs. Some landlords (company landlords will house you in either a hotel or in another apartment they have available. A similar thing happened to me. We moved and 2 days later we drove by the apartment and saw that somebody moved in after us. We could have taken our landlord to the rentalsmen but my brother lived in the same building as us and who's to say that he wouldn't make his life hell after we did that.

Your landlord cannot evict you from the unit unless you've violated your lease. However, the landlord is not obligated to renew your lease. It can take time for paperwork to go through, to get the right permits and such, so this construction might not take place for a while - like until after your lease expires. Let the landlord know that you have seen the permit requests and want to know if your lease will be renewed or not. Now's the time to start planning on looking for a new place.

Are you asking if she can kick you out if your under a lease? No she cant. That is illegal. She should either wait to remodel the apartment til after you move or give you another place to live. I also think she should cut you a break in rent because you are having to deal with the inconvenience of moving.

The landlord is under no obligation to renew your lease when it expires. Yes, she can kick you out, but not before the end of the lease, unless you manage to violate the lease terms somehow.

She is also under no obligation to give you another unit unless she requests that you leave before the end of your lease.

when your lease is expired she doesn't have to re new it. You should talk to her about it and see when she wants to do this and if you should plan to move soon.
