My mother had someone come to her house with no id and give her a supposed document from court from a collection agent becuz she owes them 9000 dollars but they want her to make these huge payments every month and sign away her florida statue right that says they cant take her house away. I thourght court papers or hearing papers were mailed not delivered and if they are delivered isnt that normally done by a sheriff? Can they make her do this ??

To be on the safe side, she needs to check with the local authorities or with the people actually calling for the payment.

This could be a scam or legit, she needs to check before doing anything.

Sure you can pay an attorney, but it would be cheaper and probably still answer the question by looking to the people that are supposedly owed and checking with the authorities.

Supeanas can be delivered by any certified/licensed person. If you are concerned about the legitimacy of the documents, simply call the court clerk's office and them about the "Cause Number" to verify. If there is no such case pending, then the papers are a bogus attempt to scare and harass. If the case is legit, you'll need to get an attorney as soon as possible to help with this case.

You DO NOT want to go to court with out an attorney. Also, if you speak with the filer of the law suit and they say they will 'drop the case' if you enter into an agreement, you STILL need an attorney. Just because they say they will do something doesn't mean they will and you'll find yourself 'missing' the court appearance, losing the case and have absolutely no way to 'undue' the judgement.

Since this has gone to the extent is has, I highly suggest you find an affordable attorney.

You do not need to be a police officer or sherrif to serve papers, as long as the papers are legitimate and properly filed, then its completely valid. Read the documents to see what those really are, it's likely a summon to court. Nothing less or more. Stop communicating with the collectors completely unless it's through a lawyer. And keep a very anal-retentive log of any dealings or attempted comunications here on out. Don't do anything without a lawyer if you don't know what you're doing.

I believe that any third party not involved in the legal matter can serve the papers.

It would be wise to check with the local government or police so that you can make sure the documents are indeed legal before making any type of payment to them.

Process servers can be a regular person by hand, it is odd look into the documents call that county and find out what is really going on.

they are normally done by a sheriff.i would call the court house or the collection agents to see if or what she can do to keep her property

She has the right to do nothing at all,, if they do not have ID, they do not have valid letters then the only thing she should give them is a Boot up the ***

she needs to call the court, and explain thei process before anything goes wrong sounds fishy dont do anything till the court explains what has happen and if is ok for her to continue the process.

I don't think that sounds right.

If it is though I'd declare bankruptcy. it will clear you debt and they wouldn't be able to go after your house.

they are trying SCAM your mother, contact the police and an attorney ASAP
