I've always considered both the first and second Die Hard movies to be Christmas movies. Yeah, they're not all cheery and Christmas spirit-y with snowmen and cookies and stuff, but they definitely give off a strong Christmas vibe to me whenever I watch them. I enjoy watching them around the holidays each year. Definitely two of my favorite movies!

It is an action movie that happens during Christmas, it is just based around the holiday, but it still has the Christmas attributes. So, sure it can be a Christmas movie. This all depends on you and what you like.

People do, but that's only because the action happens to take place at Christmas and the movie ends with a Christmas song.

No. This movie may have been set on Christmas Eve or somewhere around that time, but it is FAR FROM BEING Christmasy.
