When i bought my laptop in Berlin, I also bought an insurance for it. It covers 75% of liability upon stealing, now my laptop is stolen and the insurance company says that it was my fault and they will not pay me. Now how can i file a case against this insurance company in Germany, by the way I am not a german national and i speak very little german language.

And ya i already filed a police complain on the same day laptop was stolen and they filed it as a "stealing" and the insurance company do not consider it as stealing but my negligence and refuses to pay me.

given the amount of your loss, the only place you could file suit is in Germany.

I believe that the minimum for filing suit in Federal Court against a foreign company is $10,000. And it will only be successful if the firm in question has operations and America.

On the other hand, you are not completely powerless -- write or call your Congressperson. Their questions to the German Embassy may produce results.

Does seem like a long shot though.

Check with your states secretary of state to determine if the German company has an agent for service of process. If they do, you can file in your jurisdiction in civil or small claims court, depending on the amount of your loss. If they do not, I'm afraid you would have to initiate action in their jurisdiction, Germany, and hope for the best. Again, depending on the loss should determine if you should proceed.

Contact a lawyer in germany who will file the case for you.Thats probably still cheaper than going to germany yourself.
