underarmour sizing?

I am a 38-40 inch waist and just purchased Underarmour heat gear leggings size XX-L(40-44 inch waist),The waist was so tight I could not get into them,yes the tag says XXL.
On the other hand I have a pair of Cold Gear leggings size XXL and they fit fine,little snug
not too tight.
Do you think I have a mis-sized item?

Underarmour gear always runs small and fits tight.

No, probably not. A lot of companies have their own type of sizing. It just depends.
