It doesn't matter if your marriage isn't valid. If you have child together he has a financial responsibility to that child regardless of your marital status. All though if his name is not on the certificate for whatever reason you'll have to establish parentage. (Either he signs admitting he's the father or you pursue dna testing to prove it) You'll need an attorney and to file for child support.

The validity of the marriage is irrelevant. The father pays. Period. End of story.

The only possibile exception under the law is if a married woman has a baby, while married, and her husband is not the biological father. In that case, hubby pays if the marriage goes sideways.

Go ahead and get a lawyer. If your ex does not own up to the child being his, the court can order a paternity test. If the test determines that he is the father, it doesn't matter whether you were legally married or not. He will still have to help support the child.

Marriage has nothing to do with paternity. If he is the dad it does not matter if you are married or not. Why would you marriage not be valid in the states?

Does it matter if the marriage wasn't valid? The child is still your spouse's, is it not?
