I bought land and trailor on owner finace from a guy..I have deed to the land..but the guy would not give me the title to the trailor...could anything be done if I sell the land and just give trailor away as freebie with the land. Appreciate advice! thanks

I did take this to court and the guy wanted to settle out of court ..so my lawyer draws up a homestead deed and my lawyer was friends of the mans family so I think I really got screwed by my lawyer. I did have a contract between the man and me where i was buying the land and trailor and it was notorized. the trailor is just a 1974 model and I didn't want spend another $1500 for a lawyer..I could buy am old trailor for that.I am in TN. thanks for your answers

Do you have any proof at all that you own the trailer? If you have no proof, then you will need to kindly ask the other guy to move his trailer. If you think this guy will be a problem to you, then you may wish to let him know that it is not your intention to seek legal counsel, but should he not be cooperative, then it will leave you no other choice but to contact your attorney. What happened is that you entered the deal without going through an attorney, and that was a mistake.
You can't sell what you don't own...b/c if the owner is still on title, you don't legally own anything.
I would consult with an attorney ASAP to get your mess fixed. A note should have been drawn up, with you as the owner, an the original owner as the lienholder...and individual can do that, just like a bank.
That would give you the legal authority to sell it. Right now, you are a renter in a legal sense.
You can't "give away" the trailer either, b/c you don't own that either.

as long as you do not have the title for the trailor, you can not include the trailor as part of the sale. you can still sell the land but will have to get the other guy to move the trailor

As long as you have clear title to the land, you can evict the owner of the trailer (yes, have it removed from the land by law). Once the trailer is gone, of course, you can do as you wish with the land.
I suspect that the trailer owner might start cooperating with you once you initiate the eviction process.

Not all "trailers" have titles. If you are talking about a mobile home there may not even be a title. Most states did not start issuing titles to mobile homes until recent years. You would want to check with your state dept of motor vehicles. (I believe some states might still have it under dept of transportation).
