If you live in America, it is not illegal to upload or download pornography as long as there are no children involved.
Viewing, buying, selling, uploading, downloading child pornography will get you a nice long stretch at your favorite state prison.

Only child porn is illegal in the US. If you were suspected of any crime, or anyone you were "trading" with online was suspected, yes, there is a reasonable chance you would get caught. If you have to look at porn, make sure all parties involved are ADULTS!

You've heard wrong. It isn't a federal crime to download adult content. If the content is copyright protected, you could conceivably be sued by the copyright holder, but that's highly unlikely.
Of course, child porn is always illegal.

I don't know where you live, but most places downloading and uploading porn is not a crime (unless you are a minor).
I suppose there could be copyright infringement if you were sharing copyrighted porn --- but I don't think we are talking about that type of crime.

It is? I thought that was only for, well, illegal porn, if you know what I mean.
I'd guestimate that at least 25% of all homes have done this, whether paid for or free, photo or video, etc, all with (as far as the people know) "legal" content. None, as far as I have EVER known or heard, has ever been arrested.
But if this is true, than how can you BUY it online? From MAJOR producers?

Practically, if you download child-porn (less than age 15), you definitely in trouble.
If you up-loading porn of any age, you are also in trouble.
