My Mom wants to take my dad to court for cusody of my Brother who is 11 turning 12 in feburary. He doesnt want to go with her but she swears she will win because my dad got posession of marijuana this past year but no fine or jail time (he didnt really do it) his health is poor so he does not have a job but is looking for one. I think they will let my brother chose. Were in Virgina. what do you think they would do?

The judge will listen to what your brother has to say and he will look at all positives and negatives of both parents and then decide which one will be best for your brother legally.Good Luck

At 12 the court "may" consider his wishes, but they won't just let him choose.

A drug conviction is a pretty tough bar to getting sole custody, especially if he's also unemployed.
