This morning, we were to be in court and she did not show up. I called her to remind her last night and she told me she was in another state. I found out just now she was here in town through her aunt. She just did not go to court. This was for Non-support. She has not paid any of her child support since I was awarded custody. What happens next? I can prove she was in our town. She does have a few warrants out for her arrest.

The DA is handling the non- support thing.
I did not have a lawyer when I got custody of the kids, I did all my research and filed all my paper work on my own. I did all my investigating myself and showed proof of her as an unfit mother. It was challenging and hard but I did it.

I cant believe some of the answers you are getting. A deadbeat mom should not be treated any differently than a deadbeat dad would be. Have her put in jail for non-payment. You're not getting anything now so you're not losing anything. She needs to be taught that she is not above the law!

You don't need to prove anything. If she has warrants out it is up to them to pick her up. You can call the police and tell them where she is if you want her arrested. You should be communicating with your local child support enforcement office --- they will assign a case worker to track her down and try to make her pay. The most effective weapon they have is wage garnishment, so if she gets a real job it will usually catch up to her. However if she works under the table or constantly changes jobs and states it is VERY hard to get much. The system works for most cases --- the truly commtted non payer can run up 10's or even 100's of thousands in arrearages. Most people faced with this lose interest (especially the case workers --- they view it as wasted energy cause you can't get blood from a stone).
The best thing you can do is keep calling, keep asking, keep giving them info on where she is living and working.

Oh she get another warrant put out on her for not appearing, unless she has a real good reason as to why which has to be proven also. If she has a job that pays her with a check they'll submit an income withholding order and send to her employer or her taxes (if she files any) will be intercepted and if she tries to run to a different state to get out of her obligation, that's a felony now and once she goes to get a new drivers license they will pop her. Hope she enjoys jail cause that's where she will be soon. Good luck to you and bless those kids, they really are the true victims in this.

I would let it go. I am a single mom of 2 kids. I get no child support and he never sees them, by his choice. I came to the decision that I would rather have peace of mind and a non-turbulant life, than more money. I am now going to university so I will have more money (the dentist said that my older one will need braces in about 6 years at the latest). So I am getting my bachelors. I pefere the lifestyle of not having to deal with my ex's. It drags me down affects the kids. That is me. If you really want to fight for it than prove it and follow the legal chanels. Since you don't have a lawyer (and kutos to you for being your own lawyer!), than I would make a few phone calls and see what your next legal step should be.

If she turn into subpoenaed to be in court docket and did not tutor there'll be a warrant for her arrest. I had to arrest a woman on a contempt of court docket warrant for non charge of youngster help.

Can't the state just garnish her wages? They do that here in NYS if a parent isn't paying child support. They take it right out of your paycheck. Does she work?

The law will take care of this maybe you could drop a hint to your lawyer. It is very possible she will go to jail for non support!! Good luck to you!!!

if you can prove that she has been in town then they will come and arrest her, you wont be given any child support at that time but once she is out of prison she will have to pay.

what a mess, i remember this kind of stuff, 25yrs. when i went through it. i really feel for you. like the others have said, let the law handle it. keep a journal, phone conversations and such. it will get better for you, it really will. its called time, be patient even though i know it's hard to be.

Sorry not much you can do. She could get arrested but that won't help you get any money. Instead of stressing over it, just focus on making money. Don't count on her anymore.
