I have had a daycare in my home for 5 months now. I had a steady group of children and all seemed well. I was waiting to pursue my actual license until my youngest turned two so that I didn't have to drop one of the other two semi-toddlers, as a favor to the parents. I have taken all of the cpr & health classes, I am, trustlined with the resource center, and one of the girls whose child I care for suggested it was time I propose a standard daycare contract to protect myself financially and set some ground rules. She even told me where to go to get one and revise it. Knowing that I would be going for my license in February I decided she was probably right and a couple of parents had been having trouble paying me as well, so I figured this would be a more secure option. One parent yanked her child immediately even though I offered to make necessary changes, the other just didn't come today, but they are friends and I know she's not coming back. Can they go after me legally? I don't think

I did anything wrong and I was just trying to protect myself as a provider. Should I be worried?

They also owe me money and it's due on Friday, one lady wont even pick up her phone so I'm not sure what to do about her. They both work at a state prison, I've been told that if they don't pay I can file a complaint with their employment and they will force them to pay?

I'm not really worried about them turning me in for being unlicensed because I have the necessary background qualifications, and where I live they give you a warning and 2 months to get licensed, which is when I wanted to be licensed anyway.

You didn't do anything wrong, and you were obviously doing what was best to protect yourself and your business. They were most likely taking advantage of you and wanted to move to another sitter that will let them. They can't do a thing to you legally-- but if they did leave you with a tab, you can pursue what they owe you in small claims court. It may be a little harder without a written agreement of payment terms, but you could still pursue it if you wanted to.

They can report you for operating an unlicensed day care facility. They can not take action against you for proposing a contract.

NO I wouldn't worry as long as you don't have too many kids. Your allowed to babysit some kids without a license, but there is a limit.
