In a divorce case,unless mom is ruled unfit via child and/or drug/mental abuse charges, she will be appointed residential custodian parent being awarded physical custody of the children with support while the father, being the non-custodial parent will get state mandated visitation rights

Who ever has custody has guardianship of the children.
