Is there a law that prevents me from using various items that belong to my small town? We have various mowing equipment, a snow plow, and a wood chipper for our town and certain people have asked the mayor if they could use these items for home projects and they have been given permission by the mayor to do so. Does the mayor have that authority? I think think the taxpayers pay for these and they should only be used for the city. Also what about the liability to the city while they are in use while on loan?

Yes that is exactly what is happening, the mayor is permitting use of the equiptment by his friends. I would like to be armed with a quote of the actual law that states this if possible. I don't want to file a complaint just because I think it's wrong.

I work for a city. Your city should not be lending out the equipment to the citizens. The city is responsible for the maintenance and replacement cost to that equipment as well as any liability to someone that gets injured due to the equipment. I as a tax payer would not like to see my money wasted due to the mayor trying to be a "Good 'ol boy" and help out his friends.

Where do you live?

You're right. He shouldn't be loaning this equipment out. What I would suggest though, instead of filing a complaint, give an anonymous report to your local paper. There would be less chance of it getting out who was the whistle-blower.

city probably does subject themselves to potential liability. however, someone needs to run the city and the citizens have given that person or body the authority to do it. the way our system deals with these problems is by the vote!

I don't think he can do that, he didn't pay out of his pocket for that stuff, the tax payers did. If some one gets hurt using that stuff, the town or city will be sued. That stuff is not for public use.
