...what are the chances of me being convicted?
Can I still keep the presents he was going to give me?
Should I stick a knife in his hand and tell the police he was coming at me?

You won't get convicted if you're Dick Cheney (you'd get to keep the presents, too).

I would say, there would be a big chance of you being convicted but you could TOTALLY call self defense....
"He was in my house late at night... what was I SUPPOSED to think???"

But unfortunately, they would probably keep the presents as evidence... unless you hid them ;)


p.s. - don't plant evidence. Look how that turned out for the O.J. Simpson trial.

Don't try it. You can't even imagine how harsh elf lawyers can be. They'll have you tried, convicted and pushing up daisies before the new year rolls around.

Oh, and Santa's suit is wired with a hidden camera and mics, so you won't fool anybody with the "he was coming at me" story.

By all means, keep the presents--give a few to the judge 'just in case' as a measure of goodwill

I'd go with the knife story.

Make sure you leave most of the presents in his bag, but you can take some of the good things.

Yes. Keep the presents. They were unsolicited by you. They are yours. Slip a knife in his hand,. Make sure he can't crawl outside your house first. He has to be in the house .

Well if your state has the "Make my day Law" you will probably be fine, since he was on your property. However, it is Santa that we are talking about here..

it was self defense since you would actually be shooting a real person/burglar (and you felt threatened) in a santa suit. Grow up...... Santa is a myth.
