My BF and I are writing up an agreement. This agreement has not been finalized, nor has it been signed. We were trying to agree on shared property and I have now changed my mind. Is this unfinished draft agreement legally binding? There is no verbal contract.

it doesn't matter what you call it. there can be written, verbal or implied agreements. the usual reason people get it in writing is bc you have the burden to prove the agreement and breach when you go to court to enforce it. i would not worry about a written contract without signature bc it does not go to showing a meeting of the minds. i would worry if the other person can show through other documents or evidence that you were doing what the writing says and the writing may come in as evidence of a verbal or implied agreement or one itself.
however, if the property is land, or over a certain amount involving the sale of goods (generally 500 or more), then it's generally no good without your signature based on the statute of frauds

No. If it was witnessed, and the witness signed as well (like a public notary) than there is possibly room for either party to fight the agreement in Small Claims Court.

That promissory be conscious is a legally binding contract. So, why do no longer you flow to Small Claims courtroom and get a judgment against the guy? he would be problem to garnishment of wages or different sources through order of the courtroom.

No. A draft, by it's nature, is a "work in progress". It shows that the parties are working towards an agreement, but not that one has been reached.
