I have been dealing with this psycho buyer for 2 weeks now (prior to filing the dispute).
I know that there is NO WAY that she is going to pay me or send back the item on her own.
Is Ebay really helpful at all with situations like this?? She received a refund and now said that she cannot ship the item back because she threw it away!!
Ahhh...Im just soooo frustrated right now!!

As a buyer I had one occasion to file a dispute,but had to elevate it to claim,after Paypal did their investigation they made a judgment in favor of me,I had to wait ten days after I filed the claim,but did get my money back,it was put in my Paypal account.....

I've filed a few disputes as a buyer, but never as a seller.
As a seller, you'd want to file a dispute mainly to get your listing fees back and to possibly get their negative feedback removed from your record. But, I don't really know how you didn't receive pay, & the buyer has the item.
It's pretty simple to win the dispute if you are right. Just accurately describe the situation.
If paypal was at all involved, then solving the dispute through paypal will work better, because they can tie up the buyers money and automatically send you it. But if it wasn't through paypal, and the buyer has the item, and hasn't paid, the only thing ebay could do is suspend their account.
EDIT: rereading your addl comments, you got a great shot of winning. Even though you're supposed to wait to get the item back before you send the refund.... ebay knows it's an obvious scam when the person says they "threw the item away" If they were expecting a refund, they wouldn't have thrown it away. So, if it was through paypal, you'll get your money back. If it was not, I'm not sure how you'll get your money, but you will at least screw up their account. Wish ya luck... dont get frustrated, it's not worth it... its just an item

I've been engaged in a few disputes here and there. Some days are diamonds, some days Paypal gets involved. ;-)
Paypal should not have reversed the charges on this item until (a) you could not give them a delivery confirmation or track showing delivery (b) if delivered to Buyer, the Buyer sent the item back to you, as verified by a delivery confirmation or track.
You need to get on the phone with Paypal, ask for dispute resolution, and tell them this is clearly a case of the Buyer using the "Get Something for Nothing" ploy running around on the Internet. Offer to forward this weirdo's further emails on to them to establish your contention.
Paypal belongs to eBay, so there is no recourse to be had from eBay over a Paypal complaint. You need to stand on somebody's toes until you're satisfied.

I'm 500 sales so yes. It can get unpleasant and long winded. Never enter an email war. Just use the dispute panel and leave it open, till the item has been sent, paid for or rejected.
