My ex boss offered me a job but wanted to pay cash. She completely denied this to unemployment, but I have the job refusal email and it specifically states I cannot accept a cash position from you because it doesn't cover me as a legal employee. Now Unemployment has to go through the proper channels to see if I can still get benefits. They have the emails from me to my boss and then my boss's email back stating she was sorry she had to lay me off in the first place and good luck. She didn't deny the cash offer in the emails. Do you think Unemployment is in my favor? I have been actively seeking a job so I deserve my benefits!

My boss offerred me my job back after she layed me off. She only wants to pay cash, but she denys she said it. I have proof in my job refusal email to her. I would never have mentioned it if she didn't say it. You must report all job refusals to UI, they do check your job log.

I have been actively searching for a job, trust me UI does not pay nearly as much as I was making! I am not on welfare, I am entitled to UI while I am looking for a bonifide job!

She doesn't deny offering me a job, she offered less money and only wanted to pay me cash! She deny's offering me cash, after careful consideration I refused the job because it isn't legal. In my email to her of which I have the return email from her I mentioned the cash offer of which she didn't deny it then!

If she laid you off, then you should qualify for unemployment, assuming you had been working as an employee for a long enough time, usually at least 6 months, and she was paying into the unemployment comp system for you as she was required to do.

You'd probably have been ahead not to even mention her offer of a cash job. It isn't legal for her to do that for the same job as you had - a job's requirements and terms are what determines whether you are an employee or an independent contractor, and what she was offering isn't a legitimate job offer.

Unemployment will probably rule in your favor, but the issue of the phony job offer could muddy the waters and delay the decision.

well, your pretty much at the mercy of your case worker. do you have evidence that your past employer offered you a job? if not and its a circumstance where the employer will deny they ever offered to hire you "off the books" then its not going to count for searching for a job. You can send them a 101 emails stating that you want to work for them again or that they offered you a job, they don't have to right you back and say "I never offered you a job" they don't even have to right you back and say “I’m sorry I laid you off.” it sounds to me like you are playing a dangerous game with social security fraud and tax evasion (trying to find a job off the books and continue collecting welfare) better hope you get one of those overworked-over burdened workers who will rubber stamp anything that comes their way, though I would recommend actually going out and looking for a job and stop trying to screw over the system

you sending her a refusal IS NOT PROOF i could send you an email saying that i refused the job you just offered me and foward that to Unemployment, it doesn't mean a thing you need to give them her offer of employment
