You would be in trouble if you shot the person as if he, or she, has not entered the house, how can you call him, or her, an intruder. Probably get by if you shot a mother-in-law, as they are always intruding, even from a distance.

You can only shoot if you are in suitable fear of your life.

I would suggest if they are still outside you are not in imminent fear of your life and i'd send you down for 20.

In NC if you shoot a person in the back or while they are fleeing your property you can be charged with manslaughter.

In Missouri we have the castle doctrine. It says that you have the right to shoot if they are on or in your property. Thank the Lord for that one!!
