Santa can do whatever the #%&* he wants to do. The smoke magically dissappears when he leaves the house. Plus, since he operates outside of the normal "space-time" continuum the smoke is never really in the house.

Along with many myths and legends, even the living ones like Daddy Claus, changes have to happen in line with current custom. Who knows what he will look like in another hundred years time?We have to blame Coca Cola for his red coat and that stuck with us. Perhaps he'll arrive by particle imager and teleport his sack of goodies to be distributed via hologram to the lucky children who will be around in those days.

YES...As long as he stands outside freezing getting hypothermia not sure if he will be able to deliver to all the non smokers seeing as he now a dreaded smoker and doesn't want to be sued for passive smoking poor Santa even when its OK to climb down chimney cant win ......lol

According to the new law enacted in Minnesota a few weeks ago, Santa can smoke his pipe, but not in bars or restaurants.
so leave him plenty of eggnog and cookies...he can't stop to refill!
