Who ever owns the site that put you in touch with this scam artist should be notified immediately. If you know who you dealt with you could sue in small claims court. Or try Judge Judy.

Unless you know the guy's details (name, company, etc) and you have enough evidence in writing to support your claim....and if you live in the same country, then yes, you can sue him or her. Otherwise, then I really don't see how you can sue the guy. I don't even see why you would sue this guy for things that are very little in value. It's not worth it.
You need to find out the details of this guy - is he trading online via another website or his own website? Was there and did you read the terms and conditions of the website? If he lives in another country, you will need to see if you can find the government agency that outlines and rules and regulations on online trading/business and report him. That's pretty much all you can do. Otherwise, if you are in teh same country (i.e. US), I would compile all written correspondence and report him to government agency (police, etc).

The swee person is right on the money,I saw the same Judge Judy about a lady whom was buying cell phone for about 50 bucks,in fine print on the ad, it said a picture of the cell phone,so she recieved a picture of the cell phone,she took the lady to court and won the case.....what you need to do is go to small claims court,and file against that person for trading damaged property.Figure out the cost of those games traded and sue him for it,make sure you have evidence of the transaction first.

Sorry, but this may be your loss. Was this over ebay or something??... If it were over that, then, you may have a case...and you can report it to ebay.... but other than that, you're pretty much screwed. Suing a person costs money...probably more than what the items you are suing for are even worth........
try threatening to sue the person...
throw in some legal mumbo-jumbo...and see if that works
next time...be more careful at what you do over the web....
its a crazy crazy place...
that deal sounded a bit too good to be true in the first place...
whenever you do some type of transaction......get all of the terms in some type of writing....for your safety.

you cant sue apple or iPod they didnt break it and arent ripping you off, the guy is. Was it a trade on a public site? You would need witnesses, bank receipts, a receipt of trade, to prove it even happened. Also, since it was online, do you know the guy's real name and address? Unless you have cold hard evidence of your agreement w/ the guy its just your word vs his, if you can even find him. (Hopefully youve learned not to trust people so willingly online from all this)
Do NOT send him anything else, it was pretty naive to do it the first time.

It was a rotten trick, but to sue him would cost more than the iPod is worth. All you can do is broadcast his name or nickname on whatever forum you used so he can't do this kind of business any more. It really is too bad.

You'll probably have to contct authorities in the city where the guy lives,same for law suit or any court action.You can try your local police they may have a computer division.

Sue the scammer by tracing the ID of his computer and file the appropriate case applicable in your country.
