I know someone who fell at work & hurt their knee, The supervisor sent her to get x-rays and to be seen by a Dr. that works for their company Dr. put her on light duty with some restrictions for three days. Then a day later she got suspended for smoking next to company property(they have a non-smoking policy), Everyone smokes in thier cars or tries not to be seen. It sounds like she got suspended for a bogus reason because they put her on light duty and workmans comp. has to pay for her bills. Plus it is a male dominated workplace! Is this grounds for a lawsuite or what should She do? Any advise would be highly appreaciated!

The suspension was due to the smoking disguised as a method to quell his dependence on the company for the medical attention that he got due to the injury.

Sounds like she got suspended because of violating company policy. Just because everyone else is doing it, doesn't make it right. No matter what, workers comp. will still have to pay her bills. Even if she gets fired. As long as she does not sign any paper work stating she is fully recovered, they will be responsible. This is not a ground for a lawsuit. It is very hard to win a discrimination case based solely on this issue. My advise would be for her to do the time for the crime, then go back to work and obey the policies and try to be a safer employee for her own healths sake.

Lawsuit? LOL! She violated a company policy. You could get a lawyer, but be prepared to come up with some big time money as a retainer.

She smoked in a no smoking area,therefore she's lucky she didn't get fired. Smoking is digusting, and ruins the health of everyone around the smoker. Your friend got what she deserved.

no its probbaly her fault she fell and she was smoking when there is a no smoking policy so she shoul dhave been suspended
