1 child 3 years old. married 5 years. I want custody, my car, and the house.

whether its just his name of the property or not, whatever either one of you bought while you were legally married, belongs to both of you, even if only one name is on it. As far as custody, you can ask for full custody, if he cares about his kid, im sure he will ask for that or at least half, if the judge can't see anything wrong with either one of you, meaning your both financially stable, mentally stable and everything like that then chances are your goin to get half, just cuz your the mom dont plan on getting what you want, if you want it that bad you might have to get ugly and bring up anything that he has done in the past. If you have 2 cars, as long as you can afford it, then the judge will probably give each of you one, as far as the house, if you can afford it and he can't then obviously you will get it, if you get it anyway, you will probably have to give him some of what the house is worth, cuz if this is just a regular divorce with no abuse or anything, then the judge isn't goin to leave one of you without a car or house or take your child. If you are divorcing him cuz hes abusive or something like that then your chances are pretty high. talk to an attorney unless he agrees to everything you want, then you just have to fill out papers and file them and usually you talk to a court facilitater before the judge and you agree on things with them, then it goes to the judge to be approved. good luck

Get an attorney!!!! You are the mother so unless the father can call you a bad one you get custody....about the car and the house, im not sure of. I know where i live if HE has his name and only his name on the house and car...i THINK he gets to keep them but if yall are both on the car and house, i think you split the assets...im not too sure about this but you def. need to get a lawyer ASAP before he calls the shots on the assets first!

You will have to endure allot of pain and heartache. Divorce is for the weak who cannot endure or handle everyday life pressures. You don't want much do you? Why not say to him is there anything I can do to make this marriage (marriage counseling, clergy, therapist) work. Good Luck and may God bless all of you!

Just a lawyer... or go to court and ask the clerk she'll give you the documents you need to fill out.

file for a divorce with legal custody. simple then the lawmaster courts will decide . ?
