I live in NJ. Also what documentation do I need if I take her to small claims court?

I am in the process of moving out. The lease is on her name, I have a sublease with her in writing but the dates are not exact. She is giving me a hard time returning the security deposit back. What can I do get it back?

Have you both moved out and she got the whole deposit back from the landlord?

If so just write her a letter and ask for it. If she refuses to pay, you can take her to small claims court, and show whatever you have to document that you paid it.

If you've moved out but she's still there then unless you had a written agreement to something different, she doesn't have to give it back to you until she gets it - either gets it back from the Landlord when she leaves, or collects a new deposit from your replacement.
