I am sorry but there is no way I would ask for my husband to be declared legally dead after being missing two months. I would not except that as an option until his remains were brought home.

o.k., I can understand keeping his business running but two months seems rather short. How do you know what he has learned about survival. They don't even have a plane yet do they? The fat lady ain't singing yet.

He's dead.

It's not like the plane went missing over the South Pacific and he might be living on an island somewhere. He crashed somewhere in NW Nevada or NE California. Anywhere around there if he'd survived the crash he could have walked out by now, and if he couldn't he'd have died by now.

He was a wealthy man with hundreds, if not thousands, of people's livelihoods depending on his company. Unless he's declared dead and someone else can vote his stock and take over his decision making, the company will lose money and people will lose their jobs and their homes.

Mrs Fosset might "like" to be able to go on kidding herself that he's going to walk out of the mountains one day, but it's not going to happen, and it would be selfish to put other peoples livelihoods at risk to maintain that fiction.

With all that is involved in Fosset's estate, it is probably necessary to have him declared dead for reasons of continuing his business operations. There is no chance he survived the crash or he would have been found by now.

Usually those that are in a hurry to have their spouse declared dead are in a hurry to move the estate "along". Apply for insurance policy monies, transfer ownership of properties, be able to sell properties, and perhaps most dastardly to be able to legally move forward in relationships.
